Your landlord in Italy kept your deposit: ask for it back in writing
Italian law caps the rental deposit (deposito cauzionale) at 3 months' rent and makes it earn interest for the tenant. It sets no period for returning it, which is why a written demand matters: it puts the landlord in default and gives a date to pay. You get the letter in Italian or English.
The questions, and the documents that come with the letters (checklist, timeline, next steps and memo), are in English. The letters can be written in Italian or English.

The rules your letter follows
Taken from the official sources listed below. Interest rates change from time to time; these are the current ones.
- Maximum deposit
- 3 months' rent
- For residential and non-residential leases alike.
- Return period set by law
- None
- The deposit is due at the end of the lease, once you have handed back the property. The letter sets the date.
- Deadline in the letter
- 15 days
- A customary period, not one set by law. You can choose up to 30 days.
- Legal interest
- 1.6%
- Until 31 December 2026. Earned by the deposit each year, and owed on the unpaid deposit from the date the landlord is in default.
- Limitation period
- 10 years
- From the end of the lease and the return of the property. A written demand interrupts it.
- Court
- Tribunale
- The one where the property is, whatever the amount, with a lawyer. Mediation must be tried first.
- How to send it
- Raccomandata A/R or PEC
- Registered post with return receipt, or certified email (PEC) if the landlord has one. Send an ordinary email too.
What Italian law says about the deposit
The deposit may not be more than 3 months' rent. By law it earns interest at the legal rate, payable to the tenant at the end of each year. The law sets no period for returning it. The deposit is due back at the end of the lease, once you have handed back the property.
When you hand the property back, you are not responsible for wear from normal use or for deterioration due to age. If the landlord claims any amount from the deposit, the letter asks them to set it out in an itemised account with the supporting documents.
What the letter does
It names the lease, the deposit and the date you handed back the property, disputes the deductions you disagree with and asks for an itemised account with the supporting documents. If you choose to claim interest, it also claims any yearly interest on the deposit that was not paid, and legal interest from the date the landlord is in default.
Because no return date was agreed, it is this written demand that puts the landlord in default, and legal interest on the unpaid deposit can be claimed from then. The letter also interrupts the limitation period. It does not say that a legal deadline has passed, because there is none.
If the landlord still does not pay
Lease disputes, including the return of a deposit, go to the tribunale where the property is, whatever the amount, and you need a lawyer. Before an ordinary claim, you must try mediation (mediazione) with a lawyer. That requirement is met if the first meeting ends without agreement.
You do not need mediation to apply for a payment order (decreto ingiuntivo). But if the landlord opposes the order, you must then start mediation. This letter is not the mediation request. The escalation memo in the Complete pack explains the route.

Questions
How long does the landlord have to return the deposit?
Italian law sets no fixed period. The deposit is due at the end of the lease, once you have handed back the property, and the letter gives the landlord a date to pay. It does not claim that a legal deadline has passed.
Can my landlord keep money for wear and tear?
You are not responsible for wear from normal use or for deterioration due to age. The letter lists the deductions you dispute and asks the landlord to set out any amount they claim in an itemised account with the documents.
Do I have to go to mediation?
Yes, with a lawyer, before an ordinary court claim about a lease. If no agreement is reached at the first meeting, no further mediation fees are due. This letter is not the mediation request and does not replace it.
How long can I wait?
The claim to the deposit is time-barred 10 years after the end of the lease and the return of the property. Unpaid yearly interest on the deposit has a shorter period. A written demand interrupts the limitation period.
Can I have the letter written in English?
Yes. Italian is the default; you can choose English if your landlord reads it more easily.
